MIRACOSTA COMMUNITY COLLEGE DISTRICT
RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND
INDEMNITY/HOLD HARMLESS AGREEMENT FOR USE OF
OC CONCERT HALL FACILITY
This Release, Waiver of Liability, Assumption of Risk and Indemnity/Hold Harmless Agreement (“Waiver Agreement”) is in
connection with the use of the OC Concert Hall Facility (“Facility”) by the Undersigned User pursuant to the terms of a
Facility License Use Agreement between MiraCosta Community College District (“District”) and National Association of
Teachers of Singing (“Licensee”) dated September 17th, 2025 for use of the OC Concert Hall Facility between the hours of
7:00am and 7:00pm on November 15th, 2025.
1. User Assumption of Risk. By executing this Waiver Agreement, the undersigned acknowledges the inherent risks involved in use
of the Facility, which includes without limitation, bodily injury, illness, disease or death. THE UNDERSIGNED USER ASSUMES
ALL RISKS ASSOCIATED WITH USE OF THE FACILITY.
2. Time and Terms of Use. Use of the Facility and related areas by the undersigned User shall only be during the time permitted
under the Facility Use Agreement. Use of the Facility and shall be in accordance with the Facility Use Agreement.
3. User Release of Released Parties. In consideration for the permission to use the Facility, the User releases and agrees not to
assert any claim in any forum or in any jurisdiction against the Released Parties (as hereafter defined) for: (i) personal injury or
death; (ii) sickness or illness; (iii) loss, theft, damage or destruction of personal property; or (iv) any other loss or damages which
arise out of in any manner the use of the Facility.
4. User Indemnity of Indemnified Parties. In consideration for the permission to use the Facility, the User agrees to defend,
indemnify and hold harmless the Indemnified Parties from and against and all liabilities, lawsuits, causes of action, claims,
losses, judgments, or demands, including reasonable attorneys’fees and costs, that arise out of the User’s use of the Facility.
5. Released Parties and Indemnified Parties. The Released Parties and the Indemnified Parties are: the District, the District’s Board
of Trustees, individual members thereof and employees, officers, agents and representatives of the District.
6. Acknowledgement. I HAVE READ THIS WAIVER AGREEMENT. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY
SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE
BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE
GREATEST EXTENT ALLOWED BY LAW.
7. Minor User. If the User is a minor under the age of eighteen, this Waiver Agreement must be executed by a parent or legal guardian
of the Minor User. In such event, the parent or legal guardian executing this Agreement on behalf of a Minor User acknowledges
and agrees to the following:
I am the parent or legal guardian of the Minor User. I have read this Waiver Agreement and I am signing it freely on behalf of
myself and the Minor User. I understand the legal consequences of signing this Waiver Agreement, including (i) releasing the
District from all liability, (ii) waiving my rights and the Minor User’s rights to sue the District, (iii) and assuming all risks of the
Minor User’s use of the Facility. I permit, allow and consent to the Minor User’s use of the Facility. I understand that I am
responsible for the obligations and acts of the Minor User as described in this Waiver Agreement. I agree to be bound by the
terms of this Waiver Agreement and I agree that the Minor User is bound to the terms of this Waiver Agreement.
I accept and agree to the terms of this Waiver Agreement.
